Our Terms
1. TERM
The term of this Lease Agreement shall be no less than six (6) months from the date on this agreement and will automatically renew on a monthly basis until it is terminated or there is a default.
2. EARLY CANCELLATION
If the hirer wishes to cancel this agreement before the six month period, a $1.00 (one dollar) early cancellation fee applies.
3. PAYMENT
Payment of the total cost of the Lease Agreement is required weekly by way of automatic payment. Payments are to be made one week in advance. Please attach completed automatic payment authority provided. If there is a default in payment, a $50.00 fee will apply for every missed payment.
4. KILOMETRES
There is no kilometre limit on the vehicle for this Lease Agreement. However, it is intended that this vehicle is for personal use only. If it is being used for commercial or business purposes, a $20.00 lease surcharge, per week will apply.
5. INSURANCE
As a condition of this Lease Agreement, it is compulsory to have full cover insurance which is included in the cost of the Lease Agreement. You acknowledge that you will be responsible for paying the excess for the insurance if there is a claim submitted for the vehicle during this Lease Agreement.
6. WINDSCREEN COVER
You may elect windscreen cover as an extra option which will cover any damage to the windscreen of the vehicle. Windscreen cover is an additional $5.00 per week.
7. EXCESS
The excess for an insurance claim as follows:
$2,500 for any driver over 25 years of age;
$3,000 for any driver between 21-24 years of age;
$3,500 for any driver under 21 years of age
8. EXCESS REDUCTION
You may elect excess reduction as an extra option that will reduce your excess to the following amounts:
Over 25 years of age: Option 1: $20.00 extra weekly, excess reduced to $1500.00
Over 25 years of age: Option 2: $10.00 extra weekly, excess reduced to $2000.00
Between 21 & 24 years of age: $20.00 extra weekly, excess reduced to $2000.00
Under 21 years of age: $20.00 extra weekly, excess reduced to $2500.00
9. USE OF VEHICLE
You must not use or permit the use of the vehicle: (a) for any unlawful purpose, in violation of any law, (b) by unlicensed or uninsured drivers, (c) for any off-road use, (d) in a way that causes cancellation or suspension of insurance.
10. FUEL
The vehicle will be rented to you with a full tank of fuel. Upon surrendering of the vehicle, the fuel shall be full. If it is not, we will fill the vehicle and charge you $0.50/litre above the current pump prices and a $10.00 transaction fee for the tank to be filled.
11. MAINTENANCE AND REPAIRS
Cobalt Rentals agrees to maintain the vehicle in good working order. This excludes excess wear and tear.Warrant of Fitness (WOF) - You are responsible for booking the vehicle in for a WOF when it is due.Registration - We will have best endeavours to maintain a current registration on the vehicle. However, it is your responsibility to notify us if the registration has expired.Services- The vehicle is due for a service every six (6) months or 10,000 km’s (whichever comes first) and it is your responsibility to book the vehicle in for a service.You will not alter, mark, remove, or install equipment in the vehicle without our prior consent. You agree to allow us to inspect the vehicle at any reasonable time and place.All repairs and maintenance must be done at a workshop nominated by Cobalt Rentals. Any other work(s) done at any other workshops will be at the Hirer’s own expense.
12. EXCESS WEAR AND TEAR
Normal wear and tear is anticipated. However, you agree to pay for any costs for damage to the vehicle that is not normal wear and tear. This includes intentional damage. Damage includes, but is not limited to: dents, paint damage, missing equipment that was part of the vehicle when delivered, cracked or chipped glass, mechanical damage, holes, tears or burns to upholstery, and/or total damage that costs more than $100.00 to repair or replace.
13. TERMINATION
This agreement is terminated by either party by giving thirty (30) days notice in writing to the other party. On the date of termination, your payment liability will be the sum of:(a)Any outstanding Lease Agreement payments; (b)Any fines, liens or encumbrances;(c)Any costs to fill the vehicle with fuel;(d)Any costs incurred due to excess wear and tear; and(e)Any other costs associated with the vehicle during the time it was leased by you.Upon termination of this Lease Agreement you shall surrender the vehicle to us in good condition and repair with only ordinary wear and tear resulting from the proper use of the vehicle.
14. DEFAULT
You will be under default of this Lease Agreement if:(a)You do not make a payment when it is due;(b)You provide false and/or misleading information in your Lease Agreement application;(c)You fail to comply with any other arrangements in this Lease Agreement;(d)A proceeding in bankruptcy, receivership or insolvency is started by you or against you or your property or any of your creditors seize any of your property;(e)You die during the Lease Agreement term;(f)You do not repair or maintain or repair the vehicle as the Lease Agreement requires (Section 11); or(g)The vehicle is lost, stolen or destroyed.If you are in default, you acknowledge that we may do any or all of the following without giving you advance notice, other than any notice which may be required by applicable laws:(a)Take any reasonable measures designed to either correct the default or to save Cobalt Rentals from loss in which case you will pay us upon request for the cost and expenses incurred;(b)Terminate the Lease Agreement and your rights to possess and use the vehicle;(c)Take possession of the vehicle by any method or manner permitted by law;(d)Determine your termination liability which you agree to pay immediately upon request as set forth in Section 13; and(e)Pursue any other remedy permitted by law.You also agree to pay Cobalt Rentals for all collection and legal costs, including legal fees that Cobalt Rentals may incur.
15. TOTAL LOSS OF VEHICLE
In an event of a total loss, (i.e. the vehicle is stolen and not recovered or destroyed beyond repair), you are to notify us and the appropriate authorities immediately.
16. FINES, LIENS AND ENCUMBRANCES
You agree to keep the vehicle free of all fines, liens and encumbrances at your expense. If you do not promptly pay any fines or remove any liens or encumbrances, we may do so and you will be charged for same.
17. GENERAL
This Lease Agreement contains the entire agreement between you and us and may not be amended in any way. The terms and conditions of this Lease Agreement are subject to New Zealand law. If any portion of this Lease Agreement is ruled invalid it will not affect the other provisions within the Lease Agreement.You agree not to rent or assign this Lease Agreement, the vehicle or your right to use this vehicle. You agree to make all payments under this Lease Agreement to Cobalt Rentals. You agree that Cobalt Rentals is not responsible for the performance of any other party’s services.
